These Terms of Service (“Terms”) are a legal agreement between you and Florida Keys Cleaning LLC, doing business as Florida Keys Cleaning (“Florida Keys Cleaning,” “we,” “us,” or “our”). They govern your use of this website, our online quote tool, our phone line, and any cleaning services we provide to you.
Please read Section 13 carefully. It requires most disputes to be resolved by individual binding arbitration and it waives your right to a jury trial and to participate in a class action.
1. Acceptance of these Terms
By requesting a quote, booking a service, checking a box indicating that you agree to these Terms, calling our business line, or otherwise using our website or services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use our website or services.
You must be at least 18 years old to use this website, request a quote, book a service, or agree to these Terms. By using our website or services you represent that you are 18 or older. We do not knowingly collect information from anyone under 18.
If you are agreeing on behalf of a company, property manager, or another person, you represent that you have the authority to bind that party to these Terms.
2. Who we are
Florida Keys Cleaning LLC is a Florida limited liability company providing residential, vacation rental, and post-construction cleaning services from Fort Lauderdale through Miami and the Florida Keys to Key West.
3. Services
We provide the cleaning services described on our website and confirmed in your booking. Service descriptions on the website are general summaries. The specific scope of any particular job is what we confirm with you when the booking is made.
We may decline, reschedule, or discontinue any service at our discretion, including where a property is unsafe, inaccessible, materially different from what was described to us, or where the requested work falls outside what we offer.
4. Quotes and pricing
Prices quoted through our website, over the phone, or by our automated phone assistant are estimates based on the information you provide (property address, service type, number of bedrooms and bathrooms, frequency, and any add-ons) together with publicly available county property records associated with that address.
You are responsible for the accuracy of the information you give us. A quote is not a binding contract for a fixed price. The final price may differ if:
- the information provided was inaccurate or incomplete;
- the property’s actual size, condition, or contents materially differ from what was described;
- the address matched a different property or unit than the one to be cleaned; or
- you request additional work after the quote was issued.
If the final price will differ materially from the quote, we will tell you before we begin the work, and you may decline. Quotes expire thirty (30) days after they are issued unless we say otherwise in writing.
5. Booking, scheduling, access, and cancellation
A booking is confirmed when we confirm it to you. Requesting a quote is not a booking.
You are responsible for providing safe and lawful access to the property at the scheduled time, including any gate codes, keys, alarm codes, parking arrangements, or access instructions. If our crew cannot access the property at the scheduled time, we may treat the appointment as a cancellation.
Please give us as much notice as possible if you need to cancel or reschedule. Cancellation and rescheduling terms, including any fee for a same-day cancellation or a lockout, are those communicated to you at the time of booking.
We ask that pets be secured and that valuables, cash, jewelry, firearms, medications, and irreplaceable items be secured or removed before service.
6. Payment
Payment is due on the terms communicated to you at the time of booking. We do not collect or store payment card details on this website. Amounts remaining unpaid after their due date may be subject to interest at the maximum rate permitted by Florida law and to reasonable costs of collection.
7. Phone calls, our automated assistant, and call recording
When you call our business line, your call may be answered by an automated virtual assistant rather than by a person, and your call may be recorded and transcribed. We do this to take your request accurately, to quote and schedule work, to keep records of what was agreed, and to improve our service.
Florida is an all-party consent state for the recording of communications. By continuing with a call after being notified that the call is recorded, you consent to that recording and transcription. If you do not consent, please tell us and we will stop, or you may contact us instead by email at michael@floridakeyscleaning.com.
If you ask whether you are speaking with a person, our automated assistant will tell you honestly that it is an automated system and will offer to take a message for a person to call you back. Prices given by the automated assistant are estimates and are subject to Section 4.
8. Text messages
If you provide your mobile number and give consent, we may send you text messages about your quote, your booking, appointment confirmations and reminders, and related service updates. These messages may be sent using an automated system.
- You must be 18 or older to opt in to text messages. By providing your mobile number and consenting, you confirm that you are at least 18 years of age and that the number you provided is your own.
- Consent is not a condition of purchase.
- Message frequency varies.
- Message and data rates may apply.
- Reply STOP at any time to opt out. Reply HELP for help, or call 305-745-7450.
- Carriers are not liable for delayed or undelivered messages.
We do not share mobile numbers or text-messaging consent data with third parties or affiliates for their marketing purposes. See our Privacy Policy.
9. Your responsibilities
You agree to provide accurate information, to have the legal right to authorize cleaning at the property you give us, to disclose any known hazards at the property, and to use this website only for lawful purposes. You agree not to attempt to disrupt, overload, scrape, or gain unauthorized access to this website or our systems.
10. Disclaimers
Our services are performed with reasonable care and skill. Except as expressly stated in these Terms and to the fullest extent permitted by law, this website and our services are provided “as is” and “as available,” and we disclaim all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the website, the quote tool, or the automated phone assistant will be uninterrupted or error free, or that any estimate produced by them will match the final price. Property record data is drawn from third-party public sources and we do not warrant its accuracy.
11. Limitation of liability
To the fullest extent permitted by Florida law, Florida Keys Cleaning LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or loss of use, arising out of or relating to these Terms, the website, or our services, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms, the website, or any service we provide will not exceed the greater of (a) the amount you actually paid us for the specific service giving rise to the claim, or (b) one hundred dollars ($100).
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Florida Keys Cleaning LLC and its members, managers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the website, your provision of inaccurate information, or your failure to have authority to authorize service at a property.
13. Binding arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
13.1 Informal resolution first. Before starting an arbitration, you agree to first contact us at michael@floridakeyscleaning.com with a written description of the dispute and to give us sixty (60) days to try to resolve it informally. Most issues are resolved this way.
13.2 Agreement to arbitrate. If we cannot resolve the dispute informally, you and Florida Keys Cleaning LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, our communications with you, or any service we provide, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will take place in Monroe County, Florida, or, at your election, by telephone, by videoconference, or through submission of documents only.
13.3 CLASS ACTION WAIVER. YOU AND FLORIDA KEYS CLEANING LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If this paragraph is found unenforceable as to a particular claim, that claim, and only that claim, will be severed from arbitration and brought in court, and the remainder of this Section 13 will remain in effect.
13.4 JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FLORIDA KEYS CLEANING LLC EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR TO ANY SERVICE WE PROVIDE.
13.5 Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect its intellectual property or to stop unauthorized access to its systems.
13.6 Your right to opt out of arbitration. You may opt out of Section 13.2, 13.3, and 13.4 within thirty (30) days of first accepting these Terms by sending written notice to michael@floridakeyscleaning.com with the subject line “Arbitration Opt-Out,” stating your name, the address serviced or quoted, and that you wish to opt out. Opting out will not affect any other part of these Terms and will not affect your service in any way.
14. Governing law and venue
These Terms and any dispute arising out of them are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. For any claim not subject to arbitration under Section 13, you and Florida Keys Cleaning LLC agree to the exclusive jurisdiction and venue of the state and federal courts located in Monroe County, Florida, and each party waives any objection to that venue.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy and any booking confirmation, are the entire agreement between you and us regarding this subject.
16. Changes to these Terms
We may update these Terms from time to time. The “last updated” date above will change when we do. Continuing to use our website or services after an update means you accept the updated Terms. Any change to Section 13 will not apply to a dispute of which we already had notice.
